Sleepy Baby Happy Mama Terms and Conditions

Please read the following before purchasing any sleep programme

Introduction

This Sleep Coaching Agreement ("Agreement") is entered into between Emma Hill t/a Sleepy Baby Happy Mama ("Coach") and the client ("Client") for the purpose of providing a sleep coaching programme (“Programme”). This Agreement outlines the terms and conditions under which these services will be provided.

 

1. Services Provided
1.1 The Coach agrees to provide a Programme to the Client, which includes, but is not limited to:

  • Assessment of a sleep diary

  • Development of a personalised sleep coaching plan (“Plan”)

  • 1 hour consultation to include guidance on how to implement the Plan

  • Ongoing support via WhatsApp for 2 weeks once the Client has started the Plan


2. Client Responsibilities
2.1 The Client agrees to:

  • Disclose to the Coach if their child is under 5 months old

  • Disclose full details of their child’s health conditions to the Coach when asked and on the sleep diary

  • Complete the sleep diary over the course of 3 consecutive days using the template provided by the Coach

  • Provide accurate and complete information regarding their child’s sleep, and record this in the sleep diary

  • Return the sleep diary to the Coach via email at least 3 days prior to the consultation

  • Attend the consultation

  • Inform the Coach when they intend to start the Plan

  • Engage with the Coach during the support period

  • Inform the Coach immediately if their child becomes unwell during the support period - the Coach will pause support, upon agreement with the Client, and resume support on an agreed date with the Client when the Client’s child is well enough to continue

2.2 If the Client is no longer able to attend the consultation they must contact the Coach immediately. If the Client demonstrates exceptional circumstances as to the reason for cancellation up to 48 hours of the consultation, the Coach, on a case-by-case basis, may accept a rescheduled appointment within 2 weeks of the original date of the consultation.

2.3 The Client acknowledges that the success of the Programme depends on their commitment and effort. Outcomes may vary based on numerous factors including the child’s health and individual implementation.

2.4 The Client acknowledges that advice given by the Coach is intended as advice related to sleep and is not intended as a substitute for medical advice from a GP or other medical expert.

2.5 The Client agrees to adhere to safe sleep guidelines (as stated by the Lullaby Trust) during the Programme. If it is found to be that the Client has not adhered to safe sleep guidelines, the Coach reserves the right to terminate the Programme immediately and withdraw support.

2.6 The Client agrees to consider their own mental health state before participating in the Programme. The Client agrees to inform the Coach of any difficulties during the Programme and the Coach reserves the right to pause or cancel provision of support if they feel it will have a negative impact on the Client’s health.

 

3. Communication and Availability
3.1 WhatsApp support (via messages and voice notes) is provided for 2 weeks following the consultation once the Client has started the Plan.

3.2 The Client agrees to contact the Coach during the support hours of Monday – Sunday 9:00 AM to 6:00PM UK time.

3.3 The Coach will respond to WhatsApp messages and voice notes from the Client during the support hours. Any messages and voice notes sent after 6:00PM will be responded to the next day.

4. Fees and Payment
4.1 The Client agrees to pay the fee associated with the Programme as outlined on the Sleepy Baby Happy Mama website or as communicated directly.
4.2 Payment is due in full prior to the commencement of services unless a payment plan has been agreed upon.

5. Cancellation and Refund Policy
5.1 Either party may terminate this Agreement with written notice if the other party breaches any material term of this Agreement.

5.2 Once the Programme has been paid for in full or a payment plan has been set up, the Client may cancel the Programme at any time by providing their request in writing to the Coach.
5.3 If the Programme is cancelled by the Client, the following terms apply:

o   Before the sleep diary has been issued to the Client – 80% of the full fee will be refunded

o   After the sleep diary has been issued to the Client, but before the consultation – 60% of the fee will be refunded

o   After the consultation and provision of the Plan, but before the support period starts – 30% of the fee will be refunded

o   During week 1 of the support period – 20% of the fee will be refunded

o   During week 2 of the support period – no amount will be refunded

5.4 The Coach reserves the right to cancel the consultation at short notice due to personal circumstances. In the event of the Coach cancelling, the Client will be offered an alternative date.

5.5 The Coach reserves the right to cease the provision of support in exceptional circumstances, including but not limited to abuse or harassment.

 

6. Confidentiality
6.1 The Coach agrees to maintain the confidentiality of all information shared by the Client during the Programme, except as required by law.
6.2 The Client agrees not to share any proprietary materials or strategies provided by the Coach with third parties without written consent.

7. Intellectual Property
All materials provided by the Coach, including but not limited to templates, guides and Plans, are the intellectual property of Sleepy Baby Happy Mama.

8. Limitation of Liability
8.1 The Coach advises to the best of their ability, experience and training but does not accept responsibility or liability for sleep and behavioural work that does not achieve the desired result of the Client.

8.2 The Coach's total liability under this Agreement shall not exceed the total fees paid by the Client for the Programme.

 

9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

10. Reviews and Testimonials

The Coach is entitled to request reviews and testimonials from the Client at the end of the Programme.

Acknowledgment and Agreement
By purchasing the Programme, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
